Buenos Días, no deseo entrar en polémica y mi respetos a todos. lo unico que deseo es relatarles muy brevemente un caso increíble sucedido en el maravilloso pueblo de Boquete. Y para que e den cuenta que no todo es lo que parece.
El Sr.Phill Palmer Mcguigan, contrato los serv. de un arquitecto , para la construccion de su casa en las Terrazas. El precio y el tiempo de construccion le fue dado al sr.mcguigan con un ante proyecto .no eran los planos. El contrato presentado por el Sr.Phillip tenia techones, solo en ingles y nunca fue firmado por el arquitecto.
En el interin de la construccion el sr. phill fue pidiendo extras, extras, y mas extras, esto a su vez alargaba mas el tiempo de entrega de la residencia.
Ironicamente al finalizar la constrccion luego de demoras por extras, y pidio coneccion de los servicios de linea blanca como favor y en pleno conocimiento de que esto tomaba tiempo. Alego que su casa se le habia entregado tarde y se quedo con el dinero del arquitecto . practicamente lo quebro y no conforme con eso se dio a la tarea de dañarle la reputacion en todo el pueblo
Se procedio legalmente contra el sr.mcguigan e increiblemente despues de mas de un año de estar en el tramite legal en los juzgados en david. El juez le da valor a un contrato sin firma, tachado y en ingles y se declara incompetente.
Mr. Mcgigan se quedo con una casa de mas de medio millon de dolares , valiendose de miles de artimaña y nunca le pago al arquitecto por su trabajo.
No conforme con esto , supuestamente le dan una golpiza en su casa. cosa tan extraña porque el señor se para frente a camara a tomarse fotos y jamas se vio medicatura forense y que hace demanda penalmente al arq. acusandolo de que el lo habia madado a golpear.
Para conocimiento de todos los que residimos aqui en boquete el arq. fue declarado inocente y sobreseido definitivamente por este caso.
A lo mejor muchos de ustedes saben de este caso, pero solo concocen la version de mcguigan.
Que habra contado este señor mcguigan no se. pero lo que si lesdigo es que el arq. por confiarse de la palabra del sr.mgguigan fue estafado.
Ojala que en algun momento se pueda hacer justicia en este caso, pero con abogados y jueces honestos!!

Civil process, at least in Panama, take time. More if the lawyers use legal tactics to delay the process. Let's remember that lawyers, everywhere, work for money not justice. Something could be legal but not neccesarily will be fair or just, only legal.
I have heard people complaining about the legal system in Panama but having lived and worked in the USA I can tell you that people there also use tactics to get what they want with the help of their lawyers. Companies and people with money get the service of good and powerful lawyers to get what they want at any mean neccesary. So my final conclusion is that we are kidnapped by lawyers everywhere. They make the laws, they interpret the law and they enforce the law. Money changes everything.

Gracias por compartir tus impresiones sobre este conflicto en particular. Se han presentado pruebas de que cada historia tiene dos lados. Es lamentable cuando parece que la justicia no ha sido notificado.Esto demuestra la importancia de tener una buena representación jurídica en materia contractual. Siempre se espera que los conflictos como estos pueden ser resueltos.

You are very close to what Marilu was trying to explain.
Contractual problems have existed everywhere and in both ways. Sometimes is the provider of the service who doesnt honor the contract and sometimes is the client or customer. Having worked in the construction industry I also agree this kind of conflict is very common. Key point is communication. Both customer and service supplier must state all aspects of projects and how some problems will solved as they appear. This exercise will eliminate surprises and conflicts. Everything should be in writting and must try to cover everything. If any addition is needed it should be stated and written as an addenda to avoid additional problems later.
